Devyani Khobragade

India’s deputy consul general in New York, Devyani Khobragade, was arrested on December 10th 2013, and later released on bail, on charges of visa fraud related to her underpaying her domestic help below prevailing minimum wage laws in New York.

Her humiliation by means of public arrest has drawn sharp criticism and outrage from the Indian government.

Update as of January 9 2014: Devyani Khobragade has been formally charged by the US government but she was granted full diplomatic immunity by the US after it accepted her transfer to the UN, therefore Devyani Khobragade was asked to leave the US, which she did.

The matter is far from resolved because her husband and children are in New York and her formal charges still stand in US court which she must face if and when she returns without diplomatic immunity.

    How can a senior diplomat be married to an American and have children with American citizenship? What loyalty she has to India? How safe are Indian secrets with her as she is staying with American? Now she says that she may never be reunited with her family. So, she was living in the US for her American family, not really representing India.. Her father always talks about her ordeal in US, but never answers any questions regarding society scam they are involved in.. what a bunch of crooks…

    Why only Devyani, not others who are roots cause and promote these false tactics. Beside her all others who walk on the same path but never caught or else get release . Beside her there are far many more who do these thing and opt them as their source of living. Luckly they get save and are out of fear should feel shame for degrading the name of the land where persons like all goddess, Ghandhi and many more took birth.

    Thanks to US for taking on this fraud diplomat. I wish if US could have punished her fraud father as well. They own illegal assets like Adarsh. Accumulated wealth by corrupt practises, 11 crore for one flat, what is their salary. I want to see Devyani getting punished for the frauds she did. I know in India it will not happen, atleast US will be able to do it.

    It looks this is a fight between preet barara and indian government and Ms. khobragade became a scape goat. It appears that sikh community has been supporting sangeetha Richard but it is difficult to understand the link between this sikh community and sangeetha richards. This sikh community was the one which is pro-khalistan and also against congress government. I hope preet bharara is not with this sikh community and creating war against the indian government .

    In India Manavadharmasasthra is Ok. Enough to go once in a life time to Kasi. In the US every citizen is a citizen protected by the law and nothing more. Remember Watergate, Clinton’s apology !!Remember 2G spectrum, coal mines, Adarsh housing scheme, iron ores-All immune!! In the US house maids and IFSs are all equals!! with their rights protected by law!!!

    Any act which is not within law requires punishment or humiliation. In devyani case humiliation is preferred rather punishment. Till date the only allegation against devyani is under paymnet and at no point of time abuse, manhandling is alleged. Devyani has to be punished as per Law, if proven the alleged charges and cannot be subjected for humiliation even before proving the alleged charges. Madam we are with you, they made an attempt to demoralize you. You are largely successful in the male dominated IFS. I wish you all the best to come out of this trauma and continue to be successful and be inspiration for others.

      Diplomat will be expelled from US, but no prosecution even in case of murder. (Devyani was/is not a diplomat)

        Devyani is a diplomat if she is representing India. Which is she was.

        Also, Devyani is working on and for the UN mission not for the general India Embassy, so actually she does get diplomatic immunity.

        US thinks that they are the boss of the world, but they ain’t.

        India should from now on persecute all Americans under Indian law if any is committed…Americans have been getting too much immunity from foreign countries like: India, Pakistan and etc…

          Immunity for Diplomats is only when they make a mistake in the line of their job or duty. Not if they commit a personal crime. You cannot get immunity for everything and get away with any kind of crime because you are a diplomat.

          US, the Host country has to approve and issue G-1 visa to be a diplomat with immunity.
          She had A-1 visa, that is a Consular officer, not a diplomat
          UN can not issue visa to anybody, it has to be done by the host country.

      I do not know what records you keep score of to say that America has the most pedofiles or criminals, but you need to understand the numbers are shown there are closer to accurate because most stuff is documented. In India most of the stuff never gets documented. This accounts for the lower numbers of criminals or pedofiles or drug addicts in India. And it is not because it is truly low but because they are never documented or accounted for. For example: when HIV was first identified everyone was worried about USA having high numbers of HIV/AIDS. Now since the documentation is being scrupulously followed thanks to the Indian govt on this issue – the number of people with HIV in India is amongst the top two countries in the world with highest HIV rates.
      Similarly when you do not have the accurate numbers on pedofiles, drug addicts etc., in India; it is unreasonable to pass judgement on another country.

As for HIV/AIDS, if you find India is on the top two, well to correct you on that, India is the country with 3rd largest population of people with HIV/AIDS but still has half the ratio compared to the population as against 0.60 in the US, India has only 0.30 percent!!     I am particularly proud of Indian government and Indian people that rallied and forced to take definite stance against this situation. As much as state department wants to shut this down, India should not allow this to happen without an official apology.

      40 hours per week pay ( full time job ) Benefits ..Free Boarding Plus Free Food.
      Explanation.
      1. Full time job is suppose to cover basic needs of the employee. Vacation, health insurance etc etc.
      2. Free boarding should be separate from the employers personal residence, fully independent from work area. Living at employer,s
      residence 24 hours is not considered as free boarding but as slavery for 24 hours. Employee is subjected to call for work any time
      during day or night interrupting her own needs. Should be paid per day for 8 hours and 16 hours overtime with a rate of time and a half
      for 16 hours per day, which is illegal in USA to work 24 hours a day..

    Always we should follow the country’s rules where we are living.She could have had a char women who would come in her car & do the
    assigned work without any problem.She would have been paying the same amount that she was supposed have promised.No one can
    live with less amount,there.Most Indians in US do that.They do not take servants from here as those who live in middle east.There is a
    lot of difference from country to country.
    I felt sorry for her that she complained about the servant’s disappearance, which brought all this out.
    At least our government is fast enough to save her by changing her designation which gave the husband & children no change whatso
    ever.We have to learn a lot.

    Unfortunately many of us are not able to read the intention of USA. It is a clear violation of Vienna convention and principles of Panch Sheel. The US police must be educated how to deal with diplomats of another country.You can not have two different set of rules in international affairs one for USA and one for rest of the world.According to USA ,Edward Snowden has committed a grave crime by leaking out United States’ classified documents and now he is in Russia. In this case United States could not evacuate him by hook or crook but they evacuate the family of an Indian maid servant from India without informing the government of India.What do they mean? They are violating many international procedures and act in contempt of bilateral relationship.US government can not be blind to this.The wealth and superiority complex can not play a role in international matters particularly in diplomacy. The US action does not make it look better. It is an internal matter of two Indian citizens. USA has nothing to do in this regard. Do they pay the citizens of other countries at par with American citizens? Strip searching a civilian who is a dignitary from another country, arresting her while dropping the children at school and hand cuffing her is atrocious. Why they could not prosecute Mr. Clinton for indulging in sex with an assistant while on duty that too in President’s office of the world’s number one country.Immunity or what? No rules apply there?No one can hide for long their dirty mind in the handsome body.We never think about hurting the sentiments of US but US.

      You raise too many issues. I’m limiting my response to this one issue. Devyani is not a diplomat, her ID card (issued by Dept of State) clearly says she is a “Consular Officer with Limited Immunity” – that means she has to follow US laws. If she’s caught breaking US laws, she will be treated like any other person on US soil, except diplomats with immunity. Maid’s family had Indian passport, was not under any travel ban; they passed though Indian immigration to Air India flight and left the country. Which law is broken here?

    Well … civil service postings in foreign countries have their perks and their perils. And, the US criminal justice system, in particular, has serious issues as many know. This is the country that assassinates its citizens using robots; detains foreigners indefinitely without trial; keeps millions (largely minorities) behind bars, many in solitary confinement for years; executes the mentally unstable; but releases cold-blooded murderers who ‘stood their ground’. Funny country, US of A.

    Ms. Khobragade, especially should know this. After all, her husband and both her children are citizens of America. And, strip searching is the norm in the US. It’s, therefore, preposterous (in my opinion) to claim that one’s honour is lost as a result of the search. If anything, the honour was lost not at the point of searching, but at the point of the alleged fraud and subsequent lies. All these of course remain to be proven, and largely conjectural at this point.

    But, whatever the outcome of the diplomatic tussle, and the probable trial, one surely hopes that Ms. Khobragade uses this opportunity as a teachable moment. As a person who presumably comes from the downtrodden, who (again presumably) owes her selection to, and rise in, the Indian civil service to past victimhood of her people, she should, of all people, be able to empathize with the less fortunate and the less provided-for. She should attempt to serve as the bridge, as the ladder that closes the gap between people with the means and those with wants.

    Would she? If she did, that will be the mark of her character. It might also restore the dignity lost, and safe her from infamy.

      <> How is that possible? Her father is a senior IAS officer with very high connections to all branches of Indian gov. – including judiciary. See how fast he was able to get arrest warrant against the maid in Delhi High Court? Devyani is the Princess, the ultimate spoiled brat.

    I am a proud Indian and was saddened by the events surrounding Devyani Khobragade. However, I have to agree with the below mentioned article’s main point —

    “If somebody cannot afford to have domestic help, then they don’t have domestic help.”

    This arrest of Khobragde is insulting India because she was connected to Indian embassy. The damage of honour is irrepairable when the illtreatment in this connection is considered. Since ancient times the diplomatic immunity is provided by civilised nations and such providence is considered an honour to both sides.
